How Will Judgment, Decree And Order Be Distinguishable?

  

  JUDGEMENT

 Judgment is defined in section 2(9) of the C.P.C. which says judgment is the statement given by the Judge on the grounds of a decree or order. Judgment refers to what the judge writes regarding all the issues in the matter and the decision on each of the issues.

 

   Judgement என்பது நீதிபதி வழங்குகின்ற ஒரு தீர்ப்பாக இருக்கும்.  

  

   நீதிபதி சம்பந்தப்பட்ட வழக்கின் 

   தீர்ப்பை விரிவாக அந்த வழக்கின் தோதுவாக இருக்கின்ற அனைத்தையும் judgement ல் கொண்டுவருவார்.

  

   மேலும் judgement ல் அந்த வழக்கின் statement (அறிக்கை)யும்

  அந்த தீர்ப்பு எந்த அடிப்படையில்

சொல்லப்பட்டது , 

  *.அந்த தீர்ப்புக்கான காரணங்கள் ,

   *.  அந்த தீர்ப்புக்கு தோதுவாக இருக்கின்ற sections (relevant sections)

   *. அந்த தீர்ப்புக்கு தேவையான சாட்சியங்கள் (evidence , witness)

  *இந்த வழக்குக்கு தோதுவாக இருக்கின்ற  case laws

  

    அனைத்தும் judgement ல் இருக்கும். 

     Judgement ல் அந்த வழக்கின் முடிவு நமக்கு தெரிந்துவிடும் .

   DECREE 

   Section 2 (2) of CPC definesDecreeas follows: "Decree means the formal expression of an adjudication which, so far as regards the Court expressing it, conclusively determines the rights of the parties with regard to all or any of the matters in controversy in the suit and may be either preliminary or final.

  

    Decree follows the judgement 

  

  Decreeயில்   final statement  இருக்கும் .

 

*. Conclusive determination 

 கடைசி தீர்ப்பாக இருக்கும் 

 

*. வெற்றி பெற்றவரின் உரிமை அதில் இருக்கும் ( Rights of party )

 

* . சட்டத்தின் அடிப்படையில் adjudication (தீர்ப்பு இருக்கும் )
